Ruling is incredible and unfathomable. Per song content the dozen or so inconsequential unnoticed forever notes could just as easily be Baa Baa Black Sheep and the song remains the same. This Judgement crosses the line and will hurt the creative art rather than foster it. Kookaburra added 0.01% to Down Under. Replace it with Baa Baa Black Sheep for 12 notes and see if matters. Contrast that with taking Midnight Oil's "Short Memeory" out of The Nelson's international number one "Love and Affection". Love and affection would become blank...chorus...blank...chorus...blank...chorus, etc.
